Taylor Swift Giveaway Terms and Conditions

1. Sponsor

The Taylor Swift Concert Ticket Giveaway (“Giveaway”) is sponsored by Dan Martell, located at 1865 Dilworth Drive, #394, Kelowna BC, Canada (“Sponsor”). This Giveaway is in no way sponsored, endorsed, administered by, or associated with Meta, Twitter, Instagram, or any other social media platform.

2. Eligibility

The Giveaway is open only to legal residents of the Okanagan, specifically Kelowna, West Kelowna, Lake Country, Summerland, and Peachland, British Columbia, Canada, who are 18 years of age or older at the time of entry. Employees, officers, and directors of the Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and immediate family members are not eligible to participate. Proof of residency may be required to claim the prize.

3. Entry Period

The Giveaway begins on September 18th, 2024, at 9 a.m. PST and ends on October 16th, 2024, at 11:59 PM PST (the “Entry Period”). Entries received outside the Entry Period will not be considered.

4. How to Enter

To enter the Giveaway, participants must complete the entry form on our website and submit a one-minute video explaining why the person they are nominating deserves this giveaway. Participants may nominate themselves or others. Limit one entry per person. Multiple entries from or for the same person will be disregarded and do not influence the likelihood of winning.

5. Prize

The prize consists of two tickets to Taylor Swift’s concert in Toronto on November 16th, 2024, at 7 pm EST, including two nights’ accommodation and round-trip flights from Kelowna to Toronto. The approximate retail value of the prize is CAD 11,000. The prize is non-transferable, and no substitution will be made except at the Sponsor’s sole discretion.

Travel arrangements will be made by the Sponsor. The winner and their guest must be available to travel on the dates specified by the Sponsor. Any additional expenses not explicitly included in the prize package are the sole responsibility of the winner.

If the winner is unable to attend the concert on the specified date for any reason, including but not limited to illness, scheduling conflicts, acts of God, or travel issues, they will forfeit the entire prize package, and no alternative prize or compensation will be offered. In such a case, the Sponsor reserves the right to select an alternate winner from the remaining eligible entries.

6. Agreement to Rules

By participating, the Contestant (“You”) agrees to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements.

7. Winner Selection and Notification

Winner Selection and Notification: One (1) winner will be selected by our selection committee from all eligible entries received during the Entry Period. The selection process will be conducted on or about October 23rd, 2024. The selection will be based on criteria determined by the selection committee. The odds of winning depend on the number and quality of eligible entries received.

The potential winner will be notified via email, phone call, or in person within seven (7) days of the drawing. If the potential winner cannot be contacted, fails to respond within 48 hours, or fails to answer a time-limited skill-testing question correctly, the potential winner forfeits the prize, and an alternate winner will be selected.

8. Skill-Testing Question

Before being declared a winner, the entrant must correctly answer a mathematical skill-testing question without assistance, whether mechanical or otherwise. If the selected entrant fails to answer the question correctly, they will be disqualified, and another entrant will be randomly selected. 

9. Publicity

Media Rights and Release: By entering this giveaway, you grant the Sponsor and its affiliates the right to use your name, likeness, and entry for promotional purposes without further compensation. If the winner wishes to include a minor in any media or promotional activities related to this giveaway, written consent from the minor’s parent or legal guardian is required. The Sponsor will comply with applicable laws regarding minors in media and reserves the right to limit or exclude minor participation based on legal, ethical, or practical considerations. Use of participant information is subject to the Sponsor’s Privacy Policy.

10. Intellectual Property Rights

By submitting an entry, You grant the Sponsor a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes.

11. Taxes

All federal, provincial, and local taxes, fees, and surcharges on prizes are the sole responsibility of the winner.

12. General Conditions

The Sponsor reserves the right to cancel, suspend, and/or modify the Giveaway, or any part of it, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Giveaway, as determined by the Sponsor in its sole discretion. In such an event, the Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment.

The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Terms and Conditions or in a disruptive manner.

13. Release of Liability

By entering, You agree to release and hold harmless The Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

14. Indemnification

The winner agrees to indemnify and hold harmless the Sponsor and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any prize.

15. Governing Law

The Giveaway and these Terms and Conditions are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising out of or in connection with the Giveaway shall be adjudicated in the courts of British Columbia.

16. Privacy

Personal information collected from entrants is subject to the Sponsor’s Privacy Policy and will be used solely for the purpose of administering the Giveaway unless the entrant has opted-in to receive further communications from the Sponsor. 

17. Force Majeure

If, for any reason, the Giveaway is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaway.

18. Void Where Prohibited

The Giveaway is void where prohibited by law.

Giveaway Rules

This Taylor Swift ticket giveaway (“Giveaway”) is open to legal residents of the Okanagan region of British Columbia (The Okanagan region, for the purposes of this contest, includes the Regional District of North Okanagan, Regional District of Central Okanagan, and Regional District of Okanagan-Similkameen), who are 18 years of age or older at the time of entry. No purchase necessary. Limit one entry per person. The prize consists of two (2) tickets to a Taylor Swift concert in Toronto, Ontario (November 16th, 2024), airfare, accommodation, one dining experience, and transportation to and from the venue. Any other expenses not explicitly mentioned are the sole responsibility of the winner. The winner will be selected randomly from all eligible entries. Odds of winning depend on the number of eligible entries received. By participating, entrants agree to be bound by these terms and the decisions of the contest organizers, which are final and binding in all matters related to this Giveaway. The winner may be required to sign a declaration of eligibility, liability release, and publicity release before prize fulfillment. This Giveaway is void where prohibited by law and subject to all applicable federal, provincial, and local laws and regulations.
